SPONSOR - E.C. Barton & Company d/b/a Barton’s Home Outlet, Barton’s (“Sponsor”) runs various sweepstakes and contests (“Sweepstakes”) from time to time and are governed by these official rules (“Official Rules”). The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law. Any questions, concerns or complaints regarding the promotion will be directed to the Sponsor. 

 

ELIGIBILITY - The Sweepstakes is open to any US citizen currently residing in the U.S. who is 18 years of age or older by September 7, 2020, except where prohibited by law. Sponsor reserves the right to verify the eligibility of each entrant. Employees, former employees, and relatives of employees are excluded from entering. Sponsor reserves the right to disqualify entrants if there is evidence of tampering. By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects.

 

TIME PERIOD - Each Sweepstakes shall begin when made public and will end at various times. Sponsor may post specific time periods for each contest on its website (“Sweepstakes Period”). All entries must be received on or before the conclusion of the Sweepstakes Period as entries received after the Sweepstakes Period shall be void. 

 

HOW TO ENTER - Entries must be made by accessing the registration form available via the QR Code prominently displayed in-store at the participating locations during regular business hours. Entrants must fill out all required fields on the entry form to participate. By entering, each entrant confirms that they meet the eligibility requirements as set out above and agree to the Official Rules and Sponsor’s decision which are final and binding in all matters relating to the Sweepstakes. Automated entries are prohibited, and use of any automated devices will result in disqualification. Receipt of entries may not be acknowledged and proof of submission will not be deemed to be proof of receipt by Sponsor. All entries become the property of the Sponsor. Sponsor is not responsible for any lost, late, undelivered, misdirected, incorrect or inaccurate entries whether caused by hardware, software, or Internet resources associated with or utilized for the Sweepstakes whether caused by technical or human error during the submission and/or processing of entries.  

SELECTION OF WINNER(S) - Winners will be chosen by random drawing from all eligible entries at the end of the Sweepstakes Period. The random selection process run by the Sponsor is final. The winners will be announced on specific dates that may be listed below. If a potential prize winner cannot be reached by the Sponsor within ten (10) days, using the contact information provided at the time of entry, that potential prize winner shall forfeit the prize. Once the prize winner has been notified and reached they will have 30 days to claim their prize. If the prize is not picked up by the end of 30 days from notification, the winner shall forfeit the prize. Once a potential winner has forfeited a runner up winner will be selected. Limit one (1) prize per entrant per drawing. Sponsor is not responsible for any change in mailing address, telephone number or email address of entrants. Non-winning entries will not be carried forward to future sweepstakes.

 

SWEEPSTAKES PRIZES - All awards and prizes will be posted here one (1) $2,500 Home Outlet gift card per the specific sweepstakes. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE, IF ANY, ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

 

ADDITIONAL LIMITATIONS - Prizes are non-transferable. No substitution or cash equivalent of prizes is permitted. In the event any portion of this Sweepstakes is compromised by causes beyond Sponsor’s control which, in the sole opinion of Sponsor, impair the integrity, administration, security, or operation of this Sweepstakes, Sponsor reserves the right to cancel, suspend, extend, abbreviate or terminate the Sweepstakes if it determines, in its sole discretion, that the submission process has been impaired, compromised, undermined, or corrupted in such manner that would undermine the integrity, security, safety, success and/or feasibility of the Sweepstakes. If Sponsor elects to abbreviate the Sweepstakes, Winner(s) will be determined from all eligible entries received for Drawing(s) prior to the action or compromise giving rise to the suspension or termination of this Sweepstakes. 

 

DISPUTES - All disputes arising from or relating to the Sweepstakes shall be submitted exclusively to the jurisdiction of the state and federal courts located in the States of Arkansas. Each entrant hereby irrevocably consents to the jurisdiction of such courts and waives all objections thereto. Each entrant hereby irrevocably waives any and all right to trial by jury in any legal proceeding in connection with the Sweepstakes, the Official Rules & Regulations and any and all further transactions contemplated hereby. Except where prohibited, each entrant agrees that any and all disputes which cannot be resolved between or among the parties and any claims or causes of action arising out of or connected with this Sweepstakes, any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Any and all disputes that arise relating to the Sweepstakes must be filed within one (1) year from the date that the winner(s) is announced. 

 

INDEMNIFICATION AND LIMITATION OF LIABILITY - BY ENTERING THE SWEEPSTAKES, RECOGNIZES THAT SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES MAKE NO EXPRESS OR IMPLIED WARRANTIES AS TO THE PRIZE AND EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. 

MISCELLANEOUS - Headings are provided for reference purposes only and will not be given any substantive effect. The failure to exercise or enforce any right or provision herein shall not constitute a waiver thereof. If any provision herein is held by a court of competent jurisdiction to be invalid or unenforceable, said provision shall be enforced to the maximum extent permitted by law, and the remainder of these Official Rules shall remain in full force and effect.

 

PRIVACY - The use or disclosure of personal information submitted by entrants will be subject to Sponsor’s privacy policy which is located at https://www.homeoutlet.com/about#privacy. Except where prohibited by law, acceptance of the prize will constitute WINNER’S agreement to allow Sponsor to use the WINNER’S name, photo, or likeness in any and all media without limitation as to time or territory, and without attribution, compensation, permission or notification to the Entrant or any other party.
